What Is a Judge Trying To Do In A Money Case?
The court is simply trying to be fair. Sounds beguilingly simple, doesn’t it?
But being fair to both parties isn’t as easy as it sounds. There is an old adage in the family court that if both parties walk away a bit unhappy then the judge has probably got it about right, and there is certainly truth in that. Because a great result for one party is necessarily a worse result for the other. And while that might feel great at the time, ‘great results’ have a nasty habit of infecting your future relationships.
But if you start from the premise that the outcome has to work for you both, then you’re more likely to settle and you’re both more likely to be satisfied with the result.
