The divorce application

A divorce application is the legal process that changes your status from married to divorced. It’s a paperwork process rather than a court hearing, and it takes at least 5-6 months from start to finish. It also carries a court fee, currently £628.

Since April 2022, no-fault divorce has meant neither of you needs to give a reason for the marriage ending. You confirm, in writing, that it’s broken down irretrievably, and that’s enough.

Ending the marriage doesn’t deal with your finances, those are two separate legal processes, and you will need to action both. There are often also financial and tax consequences that flow from divorce, so it’s important to consider your overall financial situation at the same time. You also can’t remarry until your divorce is finalised.
