Recent survey highlights huge demand for a different approach to divorce

A recent survey commissioned by law firm Irwin Mitchell shows the huge demand amongst divorcing couples for a different, less confrontational approach to divorce.

1,000 divorcees contributed to the survey about their experience getting divorced, whether their relationship ending had been amicable, and how many knew what alternative dispute resolution (ADR) was. (ADR being all processes which assist couples in reaching agreement without resorting to the Family Courts).

The results speak for themselves:

  • Over 75% found their divorce stressful
  • 25% wished they’d chosen another way to end their marriage
  • 30% recall ‘lots’ of arguments during the split process
  • 40% wished they had a friendlier relationship with their ex
  • 39% didn’t know what ADR was at the time of their divorce
  • 35% weren’t offered ADR as an alternative way of resolving their dispute
  • 25% regretted not using ADR


This chimes with what we see every day at The Divorce Surgery, and what prompted our co-founders Harry and Samantha, experienced family law barristers, to set up our unique One Couple One Lawyer service.

The vast majority of divorcing couples have no interest in drama, conflict, huge legal bills or protracted delay. They just want to navigate their divorce with dignity and reach an outcome which is fair for them both and their family as a whole.

Too few divorcing couples have any understanding that they can share a lawyer on divorce, and even this recent report does not highlight that crucial point. We will continue to promote all the alternatives to adversarial litigation, so that every family can make an informed choice about the divorce that is right for them.
