Divorce Court Cases Are on the Rise – Why It Matters

Recent data shows a sharp rise in divorce court cases, with more separating couples turning to litigation to resolve financial matters. This shift raises concerns across the legal profession, not only due to increased costs but also because of the emotional toll on families.

In a recent ePrivateClient article, our co-founder Samantha Woodham shared her thoughts on this trend:

“The large increase in the proportion of divorcing couples fighting over their finances in the court arena is a worrying trend, particularly given that the research and data shows that litigation causes huge cost, delay and stress for the families involved.”

The impact of litigation often goes beyond the courtroom. For high-profile individuals, privacy is an additional concern.

“The disincentive to litigate is further amplified by the fact that they can no longer guarantee privacy in Court proceedings,” Samantha explains. “Journalists and legal bloggers are now entitled to attend and report on most family cases.”

There is also the question of autonomy.

“The blunt truth is this: the only guarantee of Court proceedings is that couples are ceding control of their financial future to a Judge, rather than retaining autonomy themselves.”

This rise in divorce court cases highlights the need for alternative ways to manage separation, ones that reduce stress and help preserve dignity.
