Family Courts Remain Paralysed By Delays As Law Society Calls For Urgent Action

New data from HM Courts & Tribunals Service (HMCTS) has once again highlighted the devastating delays and backlogs that continue to hamper the family courts. As of September, the backlog is sitting at 110,425 cases – a 2% month-on-month increase. This is also a striking increase of 6.4% from the figure of 103,790 seen in September of last year.

This is, of course, leading to delays. The average time a private law children case takes to get to final order (these are cases involving the arrangements for children of a separating couple) is now some 43 weeks.

In a recent poll by Resolution, over half of the family lawyers surveyed said it now takes an average of 1-2 years to resolve family disputes after making an initial court application.

And yet out-of-court processes, including our own, can resolve issues amicably and within weeks.
